Court hearing Frasure Creek CWA case

Judge Phillip Shepherd will hear arguments on a motion by Frasure Creek Mining and the Ky. Energy Cabinet to accept a December 2010 consent agreement between those two parties to settle thousands of Clean Water Act violations brought to light by Appalachian Voices. It is the agreement (along with a similar one with International Coal Group) that prompted intervention in the case by AppVoices, KFTC, Kentucky Riverkeeper and the Waterkeeper Alliance to represent the public interest.
